There is a fee waiver box that needs to be checked in order to apply for the Affidavit of Indigence through the WV electronic filing website. You will be required to upload the application of indigence filled out entirely. We also require that you send a notarized letter stating you checked for a valid form of ID against financial documentation with the affidavit of indigence.

The Circuit Clerk's office will be notified there is a pending case with an indigence application. Your case will be at the clerk review status until the clerk views the application and approves or denies based on the financial documentation of the applicant. If approved you will be notified of the case number, if denied you will be notified the applicant did not meet financial requirements and you will need to refile the case and pay the filing fee.
