20.03.00 - March 2020 WV E-File Updates

The following items will be available Tuesday, March 17, 2020 at approximately 8:00PM in WV E-File.

1.      E-File: Boundover, Indictment, & Information case initiation will no longer be available in E-File. The Circuit Clerk’s Office will initiate all Boundover, Indictment, & Information case filings in CourtPLUS on the Prosecutor’s behalf.

      Note: [Feature] Prosecutor will be automatically added to Boundover/Indictment/Information case filings and will therefore receive electronic notification of filing.

 

2.      E-File: [New Filing/Feature] New Motion to Intervene is available via Motions à New Motion to Intervene.

      This new filing is separate from typical New Motion filings as this unique filing requires an Intervenor party and does not require the selection of a “Represented Party,” as the New Intervenor is the represented party.

      The Intervenor is automatically added to the case, if the Judge files an Order Granting Motion to Intervene.

      The Attorney that filed the Motion to Intervene will be automatically added as the Attorney for the Intervenor, if the Judge files an Order Granting Motion to Intervene.


3.  E-File: Statute field (previously required upon selection of service by Secretary of State) has been removed. The auto-generated Request for Legal Process to be Served by the West Virginia Secretary of State document will no longer be included in the Service-Secr.pdf provided electronically upon selection of the Plaintiff – Secretary of State Service Type.

Note:  Selected Service Type will continue to be indicated on the Summons.


4.      E-File: Two Service Type options have been removed.

·         Circuit Clerk - First Class Mail (Auditor) - Including Copy Fee

Service Type Listing prior to removal:


5.  E-File:  Service Type list for State Government Employers in Suggestee Execution filings now includes All Service Type options.

Prior to this update, only the Secretary of State Service Type options were available for State Government Employers.


6.  E-File:  [New Feature] Juvenile Order of First Removal Title IV-E Findings Order Template is available in the Order Editor to suggest Order language required for WV to obtain Title IV-E funding.

Steps to apply suggested language (eligible for Title IV-E funding):

  1. Open Proposed Order filing for Juvenile Case
  2. Click Templates button
  3. folder
  4. Select Title IV-E Findings
  5. Click Open button
  6. Select applicable Findings and Click Close button
  7. Click Update button
  8. Edit Title IV-E Findings language, as needed in the Order


7.  E-File:  [New Feature] Order Templates in the Order Editor now features a Reset button. Reset button removes template selections in the Order Editor and reloads the Order Template.

  • Clear button remains available. Clear deletes template selections in the Order Editor, but does NOT remove selections/entries in the Order Template and does NOT reload the Order Template.
  • Update button remains available. Update applies entries/selections in the Order Editor (for Form orders only) and applies applicable case data entries upon Filing of the Order.

Training Tips: Check out all Order Templates available under State Templates à Miscellaneous in the Order Editor via the Templates button, as some templates offer convenient features.

  1. Divorce – Adds Date of Divorce automatically on case, upon Judge’s filing of Final Order.
  2. Modify Bond – Modifies Bond automatically on case, upon Judge’s filing of Order.
  3. Modify Bone (Form) – Bond Modification details populate in Order Modifying Bond AND Bond is automatically modified on case, upon Judge’s filing of Order.
  4. Sentencing – Adds Sentencing on case automatically, upon Judge’s filing of Order.
  5. Sentencing (Form) –Sentencing details populate in Sentencing Order AND Sentencing is automatically added on case, upon Judge’s filing of Order.
  6. Set Bond - Adds New Bond automatically on case, upon Judge’s filing of Order.
  7. Set Bond (Form) – New Bond details populate in Order Setting Bond AND New Bond is automatically added on case, upon Judge’s filing of Order.
  8. Title IV- E Findings – Populates suggested language required to obtain Title IV-E funding, based on Findings selected in the Order Editor.
