The following items will be available Thursday, August 15, 2019 at approximately 8:00 PM for the WV E-File application.

1.      E-File:  Dates are now limited to the following range: 1-1-1900 through 1-1-2100, in an effort to minimize invalid entries.

2.      E-File:  “Case Summary” tab renamed “Party List” tab.

3.      E-File: “Represented Parties” renamed “Parties Represented” & all parties display in a single list. *Additional Feature: If filing attorney is already associated with a party, the party will be auto-selected.

4.      E-File:  Miscellaneous “Certificate of Service” filing replaced “Notice of Discovery”.

5.      E-File:  Receipts now contain the style of case.

6.      E-File: Civil case defendant fee multiplier (HB2980 fee) now applies $15.00, regardless of Service selection (No Service & Hold for Later Service).

7.      E-File: Updated Email Notifications to be more intuitive and to include Filing Type & Description.

Note: Description of Supporting Documents replaced Document Type in email subject line.

8.      E-File: “Register of Foreign Support” filing no longer requires a child party, for instances of Spousal Support filings.

9.  E-File: New document type “Affidavit to Withhold Identifying Information” is now available.

10.  E-File:  Selection of "Do you wish to seal identifying information" checkbox on Domestic CIS now requires upload of “Affidavit to Withhold Identifying Information” document.

11.  E-File:  Support Information has been updated and made readily available.

12.  E-File: Recurring Parties is a new time-saving feature that minimizes repeat party entry.

To create a Recurring Party record select Account à Recurring Parties

Select Add to enter a new commonly used party record.

To retrieve Recurring Party records, select Add in any party entry tabs, then select the desired record from the Recurring Parties drop list to populate the party record.

13.  E-File: New Batch Case Subpoena (Multiple cases with one or more Subpoenaed party) filing is now available, when filing fees do not apply (i.e. Government filings).

Batch Case Subpoenas are available via the normal, single case Subpoena, filing option under Miscellaneous à Subpoena.

To file a batch case subpoena, select Yes to add Additional Cases in the Case Lookup tab.

To add Additional Cases that are not related to the case entered in Case Lookup tab, select Add.

To add Additional Cases that are related to the case in Case Lookup, select Add Related Cases.

Note: All related cases are checked by default. De-select cases that should not be included in the Subpoena filing.

Note: Filing Attorney must be associated to all related cases in the Circuit Clerk’s Case Management System for access to all cases in a related group.  The Filing Attorney must be counsel of record in the Circuit Clerk’s Case Management System (CourtPLUS), to at least one party, to gain access to file the subpoena.

If E-Filing Attorney is not counsel of record, the case style displays ***CONFIDENTIAL*** and the Attorney is encouraged to notify the Circuit Clerk’s Office before filing.

To add a Witness, select Add via Subpoena Witness tab. New Witness party will be added to all Cases selected in “Selected Cases” once filing is accepted via the Clerk’s queue.

Note:  All cases are checked by default.  De-select cases in which the witness party should not be subpoenaed and added as a party.

To Subpoena an active case party, select Add via Subpoena Party tab to open Set Service window. Select a party on one or multiple cases, click Set Party Name/Address.  Verify Name & Address in Service tab and select Service Type. Repeat steps for each party requiring subpoena.

Note:  The Selected Parties list includes all parties, on all cases in which the filer is counsel of record in CourtPLUS.  No parties are selected by default. If the list does not include all cases from the Additional Cases tab or if the system displays ***CONFIDENTIAL*** in the case style, then the filer is not counsel of record for any parties on that case(s).

Notice:  Multiple case batch subpoena filing is only available for filings without fees, such as government attorney filings.  Therefore, if a proper Government Agency is not selected, the filer will receive the following message:

Error:  Multiple case batch subpoena filing with a fee is currently not supported.
